ELIGIBILITY You must be at least 18 years of age to use our services. INTELLECTUAL PROPERTY All content, materials, software, designs, logos, trademarks, text, graphics, and other intellectual property displayed on our website and within our services are the property of NURO AI LLC or our licensors and are protected by applicable intellectual property laws. CLIENT SERVICES AND PAYMENT TERMS 8.1 For Real Estate Professionals (Clients) If you engage NURO AI LLC as a client for our lead generation and AI-powered services, the following terms apply in addition to any separate service agreement: - Setup fees are non-refundable once work has commenced - Monthly retainer fees are billed in advance on a recurring basis - Advertising spend is separate from service fees and is non-refundable as it is paid directly to advertising platforms - Services are provided on a month-to-month basis unless otherwise specified in a separate agreement - Either party may terminate the service with 30 days written notice 8.2 Performance Guarantee Any performance guarantees offered by NURO AI LLC are subject to the specific terms outlined in your individual service agreement. General marketing results cannot be guaranteed as they depend on various factors including market conditions, property details, and consumer behavior. --- 9. LIMITATION OF LIABILITY To the fullest extent permitted by applicable law, NURO AI LLC, its owners, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to your use of our services. Our total liability to you for any claims arising from or related to these Terms of Use or our services shall not exceed the total amount you have paid to NURO AI LLC in the twelve (12) months preceding the claim. This limitation of liability applies regardless of the theory of liability, whether based on contract, tort, negligence, strict liability, or any other legal theory, NURO AI LLC and mobile carriers are not liable for delayed or undelivered messages. Carriers are not responsible for the content or accuracy of any messages sent through our SMS program.. --- 10. DISCLAIMER OF WARRANTIES Our services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. INDEMNIFICATION You agree to indemnify, defend, and hold harmless NURO AI LLC, its owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising out of or related to: - Your use of our services - Your violation of these Terms of Use - Your violation of any applicable law or regulation - Any information you provide through our services that is false, misleading, or inaccurate - Any dispute between you and a real estate professional connected through our services --- 12. THIRD-PARTY SERVICES AND LINKS Our services may integrate with or contain links to third-party platforms, tools, and services including but not limited to Meta (Facebook/Instagram), Google, Zoom, and various CRM platforms. We are not responsible for the terms, privacy practices, or content of any third-party services. Your use of third-party services is subject to the respective terms and policies of those providers. --- 13. PRIVACY Your privacy is important to us.
